In short: fastest.ee lite is in closed beta and free while it is. The checks help you find problems; they do not prove your design is correct, and you stay responsible for verifying it. Your designs stay yours. The Privacy Policy says what we keep and for how long.
1. Who we are, and what these terms cover
These terms are the agreement between you and Rapla Space Agency OÜ, registry code 17540338, registered in Estonia, the company that operates fastest.ee. They govern your use of the fastest.ee lite checker. You agree to them by ticking the agreement box before an anonymous check, or by signing in and using the service. How we handle data is set out in the Privacy Policy.
In these terms a consumer means a natural person using the service wholly or mainly outside their trade, business, craft, or profession; a business or professional customer is anyone else. Some parts below apply only to consumers, and say so; where they do, business and professional customers are not covered by them, and the business or professional position stated in the relevant section applies instead.
2. The service
fastest.ee lite runs automated, rule-based checks on the design files you upload (a KiCad or Altium netlist and, where supported and successfully parsed, a BOM and a placed board) and returns an informational checklist report in which every finding cites the rule it applied. fastest.ee does not certify, confirm, prove, or guarantee anything about your design: not its compliance with any standard, nor that it is correct, safe, or manufacturable. It looks for some kinds of potential issues, not all of them, and informs you of the ones it finds. Where a finding cites a standard, that citation is the basis for the check, and does not constitute confirmation, representation, or proof that your design meets, passes, or is certified to that standard.
The checks do not find every problem. A clean report means the checks that ran found nothing, not that your design is free of defects; the absence of a reported issue does not imply that your design is safe, compliant, correct, or able to be manufactured. Results may be incomplete or wrong: a check can miss a real problem (a false negative) or flag something that is not a problem (a false positive). A finding identifies a potential issue for your review; it does not establish that a defect exists, nor predict that a board manufactured from your design would actually be defective. The report is not professional engineering advice, and it is not a substitute for your own review, testing, or qualification. You remain responsible for verifying your design; decisions about it remain yours. Nothing in this section excludes or limits any right or liability that cannot lawfully be excluded or limited.
3. Closed beta
fastest.ee lite is currently in closed beta and under active development. It is free during the beta, and results are especially preliminary. We may change, interrupt, or withdraw beta features at any time, and behaviour may change without notice.
4. Your account
You can run a check without an account. If you sign in, you do so through an identity provider (Google, GitHub, or Microsoft); we never hold a password for you. Keep your provider account secure: you are responsible for what is done when signed in as you, and you must tell us if you believe your account has been misused.
5. Acceptable use
You are responsible for the content you upload. You must not upload:
- Illegal content, or content you do not have the right to upload.
- Personally-identifying information (PII): personal data about individuals that is not necessary to run a design check.
- Export-controlled technical data: anything controlled under the U.S. International Traffic in Arms Regulations (ITAR) or the Export Administration Regulations (EAR), or the equivalent export-control law of your jurisdiction, without our prior agreement in a form reproducible in writing.
- Malicious content: exploits, malware, or any other file, design, or input intended to probe, attack, disrupt, or exploit any service, ours or anyone else's. You must not submit such content to the service in any other way either.
This applies to every upload surface. If you are unsure whether your design is export-controlled, do not upload it. You must also not probe, overload, or disrupt the service, circumvent its limits, or use another person's account without permission.
6. Your designs stay yours
You keep every right you hold in the designs you upload; we claim no ownership of them. You give us permission to process your files to run your check and to keep what the Privacy Policy says we keep, for the purposes it states. The reports generated from your design are yours to use. The checks, the rules, and the service itself remain ours; these terms give you no rights in them beyond using the service.
7. Reports and share links
The generated report is kept so its share link works, for the retention window shown when it is created (90 days by default). A share link works for anyone who has it: treat the link itself as the access, and choose who you give it to. Every report, anonymous or signed-in, expires automatically at the end of that window. An anonymous report can be deleted sooner from its delete link; a signed-in owner can delete a report sooner at any time.
8. Credit and billing
Everything paid is drawn from one credit balance: 1 credit is 1 euro. Top-ups land in that balance, and everything you spend is priced in credit, with the price shown before you spend. We are not registered for VAT at the moment, so we add no VAT: the price we show is the whole amount you pay, and invoices carry no VAT line. If we become VAT-registered later, which we expect around the time we open to the public, we will add VAT and show it separately, and settle at that point how VAT applies to credit you have already bought. There are no separate quotas or meters. Credit you paid for never expires. Credit is used oldest first: each run draws on the earliest purchase that still has credit left. If a payment needs refunding, email us at any time: the refundable amount is the unused part of what that payment added. None of this limits the statutory remedies you have as a consumer if the service does not conform to the contract. During the closed beta the service is free. fastest.ee runs as one hosted service at fastest.ee: we do not sell, license, or ship a copy for anyone else to host.
Consumers: your right to withdraw. If you are a consumer (see section 1), each purchase of credit is a separate contract for checks up to the value of that credit, and you can withdraw from it without giving a reason. The withdrawal period ends 14 days after the day you buy the credit.
To withdraw, use the "Withdraw from contract here" button next to the purchase on your Billing page, or send us a clear statement of your decision by email to findings@fastest.ee. You can use the model form below, but you do not have to. You have withdrawn in time if you send your statement before the period ends. The "Withdraw from contract here" button stays on your Billing page for 21 days after the purchase, and we accept any withdrawal sent with it in that time. If you use the Billing page, we confirm by email straight away that we have received your withdrawal, showing what you sent and when.
We start providing the paid service inside the withdrawal period only if you ask us to. You can ask when you buy credit, by ticking a box, or later, when you start your first paid check; either way you also confirm that you understand what this means. If you asked and then withdraw, you pay for the service already provided: that is the credit from that purchase you used before you told us. If you did not ask, we will not have used any of it, and we refund all of it. Once all the credit from a purchase has been used, you can no longer withdraw from that purchase.
While we process your withdrawal, paid checks on your account are paused. We refund what you are owed without undue delay, and at the latest within 14 days of receiving your statement, by the same means you paid with, at no cost to you. If you withdraw, we stop using any uploads you let us keep between that purchase and your withdrawal. You can ask us for copies free of charge, and you can delete them yourself from your account page.
Business and professional customers do not have this statutory right of withdrawal. You may use the "Withdraw from contract here" button to ask for a refund; we then apply our refund practice above, the unused part of a payment, which applies at any time.
Model withdrawal form (complete and return this only if you want to withdraw):
- To Rapla Space Agency OÜ, findings@fastest.ee:
- I hereby give notice that I withdraw from my contract for the purchase of the following credit: [what you bought].
- Ordered on: [date].
- Name of consumer: [your name].
- Address of consumer: [your address].
- Signature of consumer (only if this form is sent on paper): [signature].
- Date: [date].
9. Disclaimer of warranties
The service and its reports are provided “as is” and “as available”.
Business and professional customers: to the fullest extent permitted by law, we give no warranties, terms, or conditions of any kind, whether express, implied, or statutory, including any implied warranty or condition of accuracy, completeness, quality, fitness for a particular purpose, or non-infringement, and we do not warrant that the service will be uninterrupted, error-free, or that its results are accurate or complete.
Consumers: we give the same practical “as is” warning, but nothing in this section limits your statutory right, as a consumer, to a service that conforms to the contract, or the remedies the law gives you if it does not, including bringing the service into conformity, a proportionate price reduction, or ending the contract. Those rights stay yours whatever this section says.
10. Limitation of liability
To the fullest extent permitted by law, we are not liable for any loss or damage arising from your use of, or reliance on, the service or its results, including design defects, fabrication or assembly cost, schedule impact, lost profits, loss of data, business interruption, or any indirect, special, or consequential loss, whether the claim is in contract, in tort (including negligence), or otherwise. To the fullest extent permitted by law, our total liability for all claims in any twelve-month period is limited to the amount you paid us for the service in that period, or 50 euros if you paid nothing.
Whoever you are, this does not exclude or limit any liability that the law does not allow us to exclude or limit, in particular liability for intent or gross negligence under the Estonian Law of Obligations Act, or for death or personal injury.
Business and professional customers: that unwaivable floor is the only liability we keep; everything else above is excluded or capped to the fullest extent the law allows.
Consumers: in addition, nothing in this section excludes or limits any liability that cannot be excluded or limited under mandatory consumer law or data-protection law, including your statutory remedies as a consumer if the service does not conform to the contract. The exclusions and the cap above do not apply to that liability.
11. Indemnity
If a third party brings a claim against us because content you uploaded broke section 5 (for example, content you had no right to upload, or export-controlled data), you will compensate us for the reasonable costs and damages that claim causes us. This does not apply to the extent the claim is our own fault, and it does not limit any right you have by law.
12. Suspension, and ending the agreement
You can stop using the service at any time and ask us to delete your data (see the Privacy Policy). We may suspend or close an account, or block use, if these terms are broken, if the law requires it, or to protect the service or its users; where reasonable we will warn you first and say why. Clauses meant to outlast the agreement survive its end: your designs stay yours, and the disclaimers, liability limits, and governing law continue to apply.
13. Changes to the service and these terms
These terms may change, but only for a good reason: to reflect a change in the law or in guidance from a regulator, a change in the service or its features, a change in our security or abuse-prevention needs, or a change in how the service is priced. The current version, with its effective date, is always the one shown here. If a change is material, we will say so plainly rather than bury it, and give you reasonable notice before it takes effect; if you use the service without an account, we ask for fresh agreement before the next check runs. If you do not accept a material change, you may end the agreement before it takes effect, which for a signed-in account means you can stop and ask us to delete your data; if you do, the refund practice in section 8 (the unused part of a payment) applies. If you keep using the service after a change has taken effect, the changed terms apply.
14. Availability, and events beyond our control
We do not promise that the service will always be available or uninterrupted. The lite service carries no uptime or availability commitment and has no service-level agreement, unless you and we sign a separate written contract that sets one (see section 16). We are also not responsible for any failure or delay in providing the service that is caused by events beyond our reasonable control, such as failures of power, networks, or third-party infrastructure, cyber-attacks, industrial action, or acts of government or nature; while such an event continues, our obligation to provide the service is paused, though this does not affect your data-protection rights or any refund due to you.
15. Governing law and disputes
These terms are governed by Estonian law, and disputes are settled by the courts of Estonia. If you are a consumer, this choice of law does not take away the mandatory protections of the law of your country of residence that apply under the Rome I Regulation; those protections stay yours wherever you live. As a consumer you may bring proceedings either in the courts of your own country of residence or in the courts of Estonia, and proceedings against you as a consumer may be brought only in the courts of your country of residence. A consumer can also turn to an out-of-court body: in Estonia, the Consumer Disputes Committee at the Consumer Protection and Technical Regulatory Authority (TTJA); in other EU countries, your local consumer ADR body. Before any of that: if a finding is wrong or anything else bothers you, email findings@fastest.ee, or use the right/wrong buttons on any finding. A human reads every message; we triage weekly. If we got it wrong, we fix the check and say so.
16. Odds and ends
If part of these terms turns out to be unenforceable, the rest stays in force. Not enforcing a clause today does not waive it. We may transfer or assign these terms, in whole or in part, to another company, for example if our business or the service is sold or reorganised; a transfer will not reduce your rights under them. You may not transfer or assign your rights or obligations under these terms without our consent. These terms are the whole agreement about the lite service, and the Privacy Policy describes how we handle data. If you and we sign a separate written contract (for example an enterprise agreement), it takes precedence where it differs from these terms. Neither these terms nor a separate contract limits your statutory rights as a consumer that cannot be excluded or restricted by agreement. Report a security vulnerability to security@fastest.ee.
